General

Samviti.com is the worlds’s first scholar media dedicated to the exchange and amalgamation of knowledge around the globe. It is an online information and networking service for scholars and related groups, henceforth will be referred to as "the Service" (including this Web site and all its applications), provided by Samviti.com , henceforth referred to as "the Provider".

  1. These Terms and Conditions are an agreement that is legally binding between the Provider and any natural or legal person who, as a recipient of the service, uses the Service for any purpose, hereafter referred to as "the User".

  2. These General Terms and Conditions can be subject to additions by special terms and conditions. These are:

The Service is provided "as is" and the Provider disclaims any liability nor responsibility for any actions or inactions of other users on the website nor any breach of conditions or representations  by of the services and hereby expressly disclaim all responsibility and liability in that matter. The Provider does not promise any specific results, effects or outcome from the use of the Service.

  3. The Provider shall not mediate or resolve any dispute or disagreement between you and the other users.

  4. While the Provider has taken precautions to avoid inaccuracies in content, this website, all content, information, software, products, services and related graphics are provided as is, without warranty of any kind.

The provider does not bear the responsibility of any business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is unpredictable to both you and the Provider when using the website.

  6. The provider reserve the right to alter the website, policies, and the Conditions of Use at any time, without prior notice. You are bound to comply to the policies and Conditions of Use prevalent at the time that you use the website or that you utilise the services from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to services previously required by you)..The Provider reserves the right to change, reduce, interrupt or discontinue the Service or parts of it at any time.

  7. The Provider may terminate or suspend access to an user’s account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if the user breaches the Terms.

  8. Upon termination, the user’s right to use the Service will immediately cease.

Storage of information

  1. When a user creates an account with the Provider, the user must provide  information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

  2. The Provider neither previews nor automatically rzeviews such information. Therefore, the Provider cannot have current knowledge of; possible infringements caused by information that is stored on the request of Users. The Provider is not liable for such information (Article 14 of Directive 2000/31/EC).

  3. The user is responsible for safeguarding the password that they use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party.

  4. Users may only request storage of such information that they may legally store and publish. Users must not request to store any information that infringes any third party's copyright, trademarks, other intellectual property rights or any other rights.

The user should restitute the Provider, its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of the Conditions of Use or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.

User’s Conduct and termination

User is forbidden to utilise the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You and not the Provider,are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only. You must not use the website for any of the undermentioned

  • For fraudulent purposes, or in connection with a criminal offense or other unlawful activity to send, use or reuse any material that does not belong to you.

  • Entering offensive material(including but not limited to material that is sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libelous, obscene, pornographic, pedophilic or menacing; ethnically objectionable, disparaging or in breach of copyright, trademark, confidentiality, privacy or any other proprietary information or right; or is otherwise injurious to third parties.

  • Propagates or draws connection to money laundering or gambling.

  • Harmful to minors in any way.

  • Impersonates another person; or threatens the unity, integrity, security or sovereignty of India or friendly relations with foreign States.

  • Uploading material which contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam to cause annoyance, inconvenience or needless anxiety

Waiver

If you violate any of the abovementioned conditions and we take no action, we will still reserve the rights to use our remedies in any other situation where you breach these conditions.

Copyright and other Intellectual Property Rights

Every content featured on the website, for instance, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of the Provider,its affiliates or its content suppliers and is protected by India and international copyright, authors' rights and database right laws. The compilation of the content and the software used on this website is the property of the Provider, its affiliates or its software suppliers and is protected by India and international copyright and author' rights laws.

Extraction or re-utilisation of the content on the website via data mining, robots or similar data gathering or any extraction tools, without the written consent of the Provider and/or its affiliates is contraband.You may also not create and/ or publish your own database that features substantial (eg: absract management system, other users’ research) parts of this website without the Provider’s and / or its affiliate's expressed written consent.

Governing law and Jurisdiction

The terms and interpretations are to be construed in accordance with the laws of India, without regard to the principles of conflict of laws. In the of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Delhi courts.

Digital Millennium Copyright Act (DMCA) Information-

Samviti.com ("Samviti.com", the "Provider") respects the intellectual property rights of third parties and responds to allegations that copyrighted material has been posted, uploaded or shared on or through researchgate.net (the "Site") without authorization from the copyright holder in accordance with the safe harbor set forth in the Digital Millennium Copyright Act ("DMCA"). Samviti.com will also, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may infringe or repeatedly infringe the copyrights of others in accordance with the DMCA.

Reviews, comments, communications and other content

Users of this website may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."   • Grant Samviti.com and its affiliates a non-exclusive, royalty-free, irrevocable, perpetual and fully sublicensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and

  • Samviti.com, its affiliates and sublicensees have the right to use the name that you submit in connection with such content, if they choose.

You agree that the rights you grant above are irrevocable during the full tenure of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory coverage of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to Samviti.com, including the execution of deeds and documents, at its request.

You represent and warrant that you own or otherwise control all of the rights to the content that you post or that you otherwise provide on or through the website; that, as at the date that the content or material is submitted to the Provider:

  • the content and material is accurate.

  • use of the content and material you supply does not breach any applicable Samviti.com policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory)

  • the content is lawful.

You agree to indemnify the Provider and its affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties.

Indemnity

By using Samviti.com, you agree to indemnify, defend and Samviti.com and all of its promoters, directors, officers employees, service providers, vendors, agents; against any and all liability, losses, costs and expenses (including attorneys’ fees) incurred in connection with any claim, including, but not limited to, claims for defamation, violation of rights of publicity and/or privacy, copyright infringement or trademark infringement arising out of your dealing with other users through the use of the Samviti.com Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims

Restitution and Release

You shall restitute the Provider, its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Conditions of Use or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.

You hereby expressly release the Provider and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of other users and specifically waive any claims or demands that you may have in this behalf under any statute, contract or otherwise.

Minor

Use of Samviti.com is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use Samviti.com only with the involvement of a parent or guardian.

Communications

When you visit Samviti.com or send any e-mail or query to us, you are communicating with us electronically. It is imperative that you provide a valid phone number when registering with us. We may communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications including SMS, e-mail or phone calls from us with respect to your requirements.

Changes

The Provider reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is mandatory we will try to provide at least 60 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
